Terms of Service

By accessing or using Job Tracker Pro (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, you may not use the Service.
1. Eligibility
You must be at least 18 years old and capable of entering into legally binding agreements. By using the Service, you affirm that you meet these requirements.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account and password and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated.
3. Use of Services
Job Tracker Pro offers tools for managing customer and job data (CRM), creating and sending invoices, collecting payments via Stripe, sending quotes for digital signature via Docuseal, accessing AI-powered chat assistance, and navigating job sites using Google Maps or Apple Maps. You agree not to use the Service for any unlawful purpose, to upload harmful, deceptive, or inappropriate content, or to violate the terms of third-party platforms such as Stripe, OpenAI, or mapping providers.
4. Fees and Billing
The Service may charge monthly or yearly subscription fees. A 1% platform fee for for pro users, (2% for free users), is applied to all Stripe payments processed through the app, subject to change with advance notice. Stripe charges separate processing fees which you are solely responsible for.
5. Subscription Terms
Subscriptions are billed in advance and automatically renew. You may cancel at any time through your Apple or Android subscription settings. No refunds will be issued. You are responsible for managing your own subscription and ensuring timely cancellation prior to renewal to avoid being charged.
6. AI Disclaimer
The chatbot feature is powered by OpenAI and is for informational and productivity purposes only. It may be inaccurate, outdated, or misleading. Do not rely on it for legal, financial, or safety-critical decisions. We are not liable for any actions you take based on AI outputs. You acknowledge and accept full responsibility for any decisions made based on the chatbot’s output.
7. Navigation Tools
Routing is powered by Apple Maps and Google Maps. We do not guarantee accuracy or travel safety. Use common sense and comply with local traffic laws.
8. Limitation of Liability
To the fullest extent permitted by law, Elevated Software Solutions, LLC and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, data loss, unauthorized access, service disruptions, or third-party service failures, including but not limited to Stripe, OpenAI, and mapping platforms. We are not liable for misuse or inaccuracies resulting from user behavior or AI chatbot responses.
9. Indemnification
You agree to indemnify, defend, and hold harmless Elevated Software Solutions, LLC, its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
10. No Warranty
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
11. User Content
You retain ownership of content you input or upload but grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely to operate and improve the Service. You are responsible for your content and its legality.
12. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including acts of God, outages, natural disasters, government actions, or cyberattacks.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without notice, if you violate these Terms, risk harm to the platform or others, or if required by law.
14. Changes to Terms
We may update these Terms at any time. Continued use of the Service constitutes your acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved exclusively in the state or federal courts located in Westmoreland County, Pennsylvania. You consent to the jurisdiction and venue of such courts.
16. Taxes
As a user of Job Tracker Pro, you are solely responsible for determining, collecting, reporting, and remitting any applicable taxes (including but not limited to sales, VAT, GST, or income taxes) related to payments you receive through the platform. Job Tracker Pro does not collect, calculate, or remit taxes on your behalf.
You are responsible for complying with all local, state, national, and international tax laws applicable to your business activities. We recommend consulting with a qualified tax advisor to ensure your compliance.
